State laws and rights

Some states have data privacy laws to protect the personal information of their residents and provide residents with certain rights. To learn more about the privacy rights Brightspeed offers under these laws, subject to certain exceptions and limitations, please see below.

State privacy rights

Effective: January 1, 2020

The California Consumer Privacy Act (CCPA) (which was amended by the California Privacy Rights Act (CPRA)) gives specific rights to California consumers, namely our California employees and job applicants (although these types of individuals are not covered under the other laws below). These California consumers may have the right to: 

  • Request to know (a) the categories of personal information we collect, use, disclose for a business purpose, and share about you (b) the categories of sources from which we collected personal information about you; (c) our purposes for collecting or sharing personal information; and (d) the categories of third parties to which we have shared personal information or disclosed it for a business purpose

  • Request to access the specific pieces of personal information we have collected about you

  • Request to delete the personal information we have collected from you

  • Request the correction of inaccurate personal information

  • Opt out of our “sharing” of personal information for the purposes of targeted advertising (known as “cross-context behavioral advertising” under California law)

  • Not receive discriminatory treatment for exercising your privacy rights

While the CCPA provides an opt-out opportunity for certain uses or disclosures of “sensitive personal information” (as defined by the CCPA), Brightspeed uses and discloses such information only for purposes that do not require an opt-out opportunity under the CCPA.

Effective: January 15, 2025

The New Jersey Data Protection Act gives specific rights to New Jersey consumers. New Jersey consumers may have the right to:

  1. Confirm that we process personal information about you

  2. Request to obtain a copy of the personal information we maintain about you in a portable format

  3. Request to delete your personal information

  4. Request the correction of inaccurate personal information 

  5. Opt out of our “sales” of personal information for the purposes of targeted advertising

Effective: July 1, 2024

The Texas Data Privacy and Security Act gives specific rights to Texas consumers. Texas consumers may have the right to:

  1. Confirm that we process personal information about you

  2. Request to obtain a copy of the personal information you previously provided to us in a portable format

  3. Request to delete your personal information (where the law allows)

  4. Request the correction of inaccurate personal information

  5. Opt out of our “sales” of personal information for the purposes of targeted advertising
